Chương I

VỊ TRÍ VÀ CHỨC NĂNG

Điều 1. Vị trí và chức năng:

1. Vị trí:

Phòng Nội vụ Quận 8 là cơ quan chuyên môn thuộc Ủy ban nhân dân Quận 8.

Phòng Nội vụ Quận 8 chấp hành sự chỉ đạo, quản lý về tổ chức, vị trí việc làm, biên chế công chức, cơ cấu ngạch công chức và công tác của Ủy ban nhân dân Quận 8, đồng thời chập hành sự chỉ đạo, kiểm tra, hướng dẫn về chuyên môn, nghiệp vụ của Sở Nội vụ.

2. Chức năng:

Phòng Nội vụ Quận 8 có chức năng tham mưu, giúp Ủy ban nhân dân quận quản lý nhà nước về: Tổ chức bộ máy; vị trí việc làm; biên chế công chức và cơ cấu ngạch công chức trong các cơ quan, tổ chức hành chính nhà nước; vị trí việc làm, cơ cấu viên chức theo chức danh nghề nghiệp và số lượng người làm việc trong các đơn vị sự nghiệp công lập; tiền lương đối với cán bộ, công chức, viên chức, lao động hợp đồng trong cơ quan, tổ chức hành chính, đơn vị sự nghiệp công lập; cải cách hành chính; chính quyền địa phượng; địa giới hành chính; cán bộ, công chức, viên chức; cán bộ, công chức phường và những người không chuyên trách ở phường; hội, tổ chức phi chính phủ; văn thư, lưu trữ nhà nước; tôn giáo; thi đua - khen thưởng; công tác thanh niên.

Chương II

NHIỆM VỤ VÀ QUYỀN HẠN

Điều 2. Nhiệm vụ và quyền hạn:

Phòng Nội vụ Quận 8 có nhiệm vụ và quyền hạn sau đây:

1. Trình Ủy ban nhân dân, Chủ tịch Ủy ban nhân dân quận ban hành quyết định, chỉ thị; quy hoạch, kế hoạch dài hạn, năm năm và hàng năm; chương trình, biện pháp tổ chức thực hiện các nhiệm vụ cải cách hành chính nhà nước thuộc lĩnh vực quản lý nhà nước được giao.

2. Tổ chức thực hiện các văn bản pháp luật, quy hoạch, kế hoạch sau khi phê duyệt; thông tin, tuyên truyền, phổ biến, giáo dục, theo dõi thi hành pháp luật về các pháp luật về các lĩnh vực thuộc phạm vi quản lý được giao.

3. Về tổ chức, bộ máy:

a) Trình Ủy ban nhân dân, Chủ tịch Ủy ban nhân dân quận ban hành văn bản quy định cụ thể chức năng, nhiệm vụ, quyền hạn, tổ chức của Phòng Nội vụ quận theo quy định và theo hướng dẫn của Ủy ban nhân dân Thành phố;

b) Tham mưu, giúp Ủy ban nhân dân quận trình cấp có thẩm quyền quyết định việc thành lập, sáp nhập, chia tách, giải thể các cơ quan chuyên môn thuộc Ủy ban nhân dân quận;

c) Thẩm định về nội dung đối với dự thảo văn bản quy định chức năng, nhiệm vụ, quyền hạn và tổ chức của các cơ quan chuyên môn, đơn vị sự nghiệp công lập thuộc Ủy ban nhân dân quận;

d) Thẩm định đề án thành lập, tổ chức lại, giải thể các đơn vị sự nghiệp công lập thuộc thẩm quyền quyết định của Ủy ban nhân dân quận theo quy định của pháp luật và theo phân cấp của Ủy ban nhân dân Thành phố;

đ) Tham mưu, giúp Ủy ban nhân dân quận trong việc trình Ủy ban nhân dân Thành phố quyết định thành lập, tổ chức lại, giải thể các đơn vị sự nghiệp công lập thuộc Ủy ban nhân dân quận theo quy định của luật chuyên ngành;

e) Thẩm định việc thành lập, kiện toàn, sáp nhập, giải thể các tổ chức phối hợp liên ngành thuộc thẩm quyền quyết định của Chủ tịch Ủy ban nhân dân quận theo quy định của pháp luật.

4. Về quản lý, sử dụng biên chế công chức, số lượng người làm việc trong đơn vị sự nghiệp công lập:

a) Thẩm định, trình Ủy ban nhân dân quận, Chủ tịch Ủy ban nhân dân quận kế hoạch biên chế công chức, kế hoạch số lượng người làm việc hàng năm của các cơ quan, đơn vị sự nghiệp công lập thuộc thẩm quyền quản lý của Ủy ban nhân dân quận để Ủy ban nhân dân quận trình Ủy ban nhân dân Thành phố theo quy định;

b) Trình Chủ tịch Ủy ban nhân dân quận giao biên chế công chức, giao số lượng người làm việc trong đơn vị sự nghiệp công lập sau khi được cấp có thẩm quyền phê duyệt;

c) Giúp Ủy ban nhân dân quận hướng dẫn, kiểm tra việc quản lý, sử dụng biên chế công chức, số lượng người làm việc trong đơn vị sự nghiệp công lập theo quy định của pháp luật;

d) Tổng hợp, báo cáo biên chế công chức, số lượng người làm việc trong các cơ quan, tổ chức hành chính, đơn vị sự nghiệp công lập theo quy định của pháp luật;

đ) Giúp Ủy ban nhân dân quận tổng hợp chung việc thực hiện các quy định về chế độ tự chủ, tự chịu trách nhiệm về sử dụng kinh phí quản lý hành chính đối với các cơ quan nhà nước theo quy định của pháp luật.

5. Về quản lý vị trí việc làm, cơ cấu chức danh công chức, viên chức:

a) Trình Ủy ban nhân dân quận ban hành văn bản chỉ đạo, hướng dẫn các cơ quan, tổ chức, đơn vị thuộc Ủy ban nhân dân quận quản lý xây dựng đề án vị trí việc làm, cơ cấu chức danh công chức, viên chức hoặc đề án điều chỉnh vị trí việc làm, cơ cấu chức danh công chức, viên chức theo quy định của pháp luật và theo chỉ đạo, hướng dẫn của Ủy ban nhân dân Thành phố;

b) Giúp Ủy ban nhân dân quận đôn đốc, theo dõi, thẩm định, tổng hợp việc xây dựng đề án vị trí việc làm, cơ cấu chức danh công chức, viên chức hoặc đề án điều chỉnh vị trí việc làm, cơ cấu chức danh công chức, viên chức trong các cơ quan, tổ chức, đơn vị thuộc thẩm quyền quản lý của Ủy ban nhân dân quận để trình Ủy ban nhân dân Thành phố thẩm định; giúp Ủy ban nhân dân quận tổng hợp danh mục vị trí việc làm, cơ cấu chức danh công chức, viên chức của huyện để trình Ủy ban nhân dân Thành phố theo quy định;

c) Trình Ủy ban nhân dân quận thực hiện việc sử dụng, quản lý vị trí việc làm và cơ cấu chức danh công chức, viên chức trong các cơ quan, tổ chức, đơn vị thuộc Ủy ban nhân dân quận theo quy định, theo phân cấp hoặc ủy quyền của Ủy ban nhân dân Thành phố.

6. Về công tác xây dựng chính quyền:

a) Tham mưu, giúp Ủy ban nhân dân quận trong việc tổ chức và hướng dẫn công tác bầu cử đại biểu Quộc hội, bầu cử đại biểu Hội đồng nhân dân các cấp trên địa bàn theo quy định của pháp luật và hướng dẫn của Ủy ban nhân dân Thành phố;

b) Giúp Ủy ban nhân dân quận trình Hội đồng nhân dân cấp quận bầu, miễn nhiệm bãi nhiệm Chủ tịch, Phó Chủ tịch và các thành viên khác của Ủy ban nhân dân quận theo quy định của pháp luật;

c) Trình Chủ tịch Ủy ban nhân dân quận phê chuẩn kết quả bầu cử, phê chuẩn việc miễn nhiệm, bãi nhiệm thành viên Ủy ban nhân dân phường theo quy định;

d) Giúp Ủy ban nhân dân quận trình Chủ tịch Ủy ban nhân dân cấp tỉnh phê chuẩn kết quả bầu cử, phê chuẩn việc miễn nhiệm, bãi nhiệm thành viên Ủy ban nhân dân quận theo quy định của pháp luật;

đ) Xây dựng, trình Ủy ban nhân dân quận đề án liên quan đến việc thành lập, giải thể, nhập, chia, điều chỉnh địa giới đơn vị hành chính, đổi tên đơn vị hành chính, phân loại đơn vị hành chính trong, địa bàn để Ủy ban nhân dân trình cấp có thẩm quyền xem xét, quyết định;

e) Tham mưu, giúp Ủy ban nhân dân quận hưỡng dẫn và tổ chức triển khai thực hiện các đề án, văn bản liên quan đến công tác địa giới hành chính, phân loại đơn vị hành chính sau khi được cấp có thẩm

g) Giúp Ủy ban nhân dân quận trong việc quản lý hồ sơ, bản đồ địa giới, mốc, địa giới hành chính của quận theo quy định của pháp luật;

h) Tham mưu, giúp Ủy ban nhân dân quận hướng dẫn, kiểm tra, tổng hợp, báo cáo việc thực hiện pháp luật về dân chủ ở phường, ở cơ quan hành chính, đơn vị sự nghiệp công lập, ở doanh nghiệp trên địa bàn và việc thực hiện công tác dân vận của chính quyền theo quy định;

i) Tham mưu, trình Ủy ban nhân dân quận trong việc hướng dẫn thành lập, giải thể, sáp nhập và kiểm tra, tổng hợp, báo cáo về hoạt động của khu phố, tổ dân phố trên địa bàn quận theo quy định; thực hiện việc bồi dưỡng công tác cho cấp trưởng, cấp phó của khu phố, tổ dân phố theo quy định;

7. Về cán bộ, công chức, viên chức; cán bộ, công chức phường và những người hoạt động không chuyên trách ở phường:

a) Trình Chủ tịch Ủy ban nhân dân quận quyết định việc tuyển dụng, sử dụng, quản lý vị trí việc làm, điều động, bổ nhiệm, bổ nhiệm lại, cho từ chức, luân chuyển, biệt phái, khen thưởng, kỷ luật, đánh giá, thôi việc nghỉ hưu, thực hiện chế độ tiền lương, chế độ đãi ngộ và các chế độ, chính sách khác đối với cán bộ, công chức, viên chức thuộc thẩm quyền quản lý của Ủy ban nhân dân quận theo quy định của pháp luật và phân cấp của Ủy ban nhân dân Thành phố;

b) Thực hiện công tác quản lý hồ sơ, công tác đào tạo, bồi dưỡng chuyên môn nghiệp vụ, kiến thức quản lý đối với cán bộ, công chức, viên chức, cán bộ, công chức phường theo quy định của pháp luật, theo phân cấp quản lý của Ủy ban nhân dân Thành phố và hướng dẫn của Sở Nội vụ;

c) Giúp Ủy ban nhân dân quận thực hiện việc tuyển dụng, quản lý công chức phường; thực hiện chế độ, chính sách đối với cán bộ, công chức phường và những người hoạt động không chuyên trách ở phường theo quy định

8. Về cải cách hành chính, cải cách chế độ công vụ, công chức:

a) Trình Ủy ban nhân dân quận lãnh đạo, chỉ đạo, triển khai, đôn đốc, kiểm tra các cơ quan chuyên môn cùng cấp và Ủy ban nhân dân phường thực hiện công tác cải cách hành chính, cải cách chế độ công vụ, công chức ở địa phương;

b) Trình Ủy ban nhân dân quận các biện pháp đẩy mạnh cải cách hành chính, đẩy mạnh cải cách chế độ công vụ, công chức trên địa bàn quận;

c) Thực hiện công tác tổng hợp, báo cáo về cải cách hành chính, cải cách chế độ công vụ, công chức ở địa phương theo quy định;

d) Trình Ủy ban nhân dân và Chủ tịch Ủy ban nhân dân quận quyết định phân công các cơ quan chuyên môn thuộc Ủy ban nhân dân quận chủ trì hoặc phối hợp thực hiện các nội dụng, công việc của cải cách hành chính, bao gồm: cải cách thể chế, cải cách thủ tục hành chính, cải cách tổ chức bộ máy hành chính, xây dựng và nâng cao chất lượng đội ngũ cán bộ, công chức, viên chức, cải cách tài chính công, hiện đại nền hành chính;

đ) Hướng dẫn, đôn đốc, kiểm tra việc thực hiện cơ chế một cửa, một cửa liên thông, hiện đại tại các cơ quan hành chính Nhà nước ở địa phương;

e) Hướng dẫn, đôn đốc, kiểm tra các cơ quan chuyên môn thuộc Ủy ban nhân dân quận và Ủy ban nhân dân phường triển khai thực hiện công tác cải cách hành chính, cải cách chế độ công vụ, công chức theo chương trình, kế hoạch, đề án cải cách hành chính, cải cách chế độ công vụ, công chức đã được cấp có thẩm quyền phê duyệt.

9. Giúp Ủy ban nhân dân quận thực hiện quản lý nhà nước về tổ chức và hoạt động của hội, quỹ xã hội, quỹ từ thiện trên địa bàn theo quy định của pháp luật và theo ủy quyền của Chủ tịch Ủy ban nhân dân Thành phố.

10. Về công tác văn thư, lưu trữ:

a) Hướng dẫn, kiểm tra việc thực hiện các chế độ, quy định về văn thư, lưu trữ của Nhà nước và của Thành phố đối với các cơ quan, tổ chức ở quận và phường theo quy định của pháp luật.

b) Thực hiện công tác báo cáo, thống kê về văn thư, lưu trữ theo quy định của pháp luật.

11. Về công tác thi đua, khen thưởng:

a) Tham mưu, đề xuất với Ủy ban nhân dân quận tổ chức các phong trào thi đua và triển khai thực hiện chính sách khen thưởng của Đảng và Nhà nước trên địa bàn quận; làm nhiệm vụ Thường trực của Hội đồng Thi đua - Khen thưởng quận;

b) Hướng dẫn, kiểm tra, đôn đốc việc thực hiện kế hoạch, nội dung thi đua, khen thưởng trên địa bàn quận; xây dựng, quản lý và sử dụng Quỹ thi đua, khen thưởng theo quy định của pháp luật.

12. Về công tác tôn giáo:

a) Giúp Ủy ban nhân dân quận chỉ đạo, hướng dẫn, kiểm tra và tổ chức thực hiện các chủ trương của Đảng, chính sách, pháp luật của nhà nước về tôn giáo và công tác tôn giáo trên địa bàn quận;

b) Chủ trì, phối hợp với các cơ quan chuyên môn cùng cấp để thực hiện nhiệm vụ quản lý nhà nước về tôn giáo trên địa bàn theo phân cấp của Ủy ban nhân dân Thành phố và theo quy định của pháp luật;

c) Tham mưu, giúp Ủy ban nhân dân quận giải quyết những vấn đề cụ thể về tôn giáo theo quy định của pháp luật và theo hướng dẫn của Sợ Nội vụ.

13. Về công tác thanh niên:

a) Tổ chức triển khai thực hiện các văn bản quy phạm pháp luật, chiến lược, chương trình, kế hoạch phát triển thanh niên và công tác thanh niên;

b) Hướng dẫn, tuyên truyền phổ biến, giáo dục pháp luật về thanh niên và công tác thanh niên theo quy định; giải quyết những vấn đề liên quan đến thanh niên, công tác thanh niên theo quy định và theo phân cấp;

c) Chủ trì, phối hợp với các cơ quan liên quan và các tổ chức khác của thanh niên trong việc thực hiện hoặc đề nghị cấp có thẩm quyền thực hiện cơ chế, chính sách đối với thanh niên và công tác thanh niên theo quy định.

14. Trình Ủy ban nhân dân quận ban hành các văn bản hướng dẫn về công tác nội vụ trên địa bàn; hướng dẫn chuyên môn, nghiệp vụ về công tác nội vụ đối với các cơ quan, đơn vị ở quận và Ủy ban nhân dân phường.

15. Thực hiện việc kiểm tra, giải quyết các khiếu nại, xử lý theo thẩm quyền hoặc báo cáo cấp có thẩm quyển xử lý các vi phạm về công tác nội vụ trong địa bàn quận theo quy định. Thực hiện công tác phòng, chống tham nhũng, thực hành tiết kiệm, chống lãng phí theo quy định của pháp luật và phân công của Ủy ban nhân dân quận.

16. Thực hiện công tác thông kê, thông tin, báo cáo, Chủ tịch Ủy ban nhân dân quận và Giám đốc Sở Nội vụ về tình hình, kết quả triển khai công tác nội vụ trên địa bàn.

17. Tổ chức triển khai, ứng dụng tiến bộ khoa học, công nghệ; xây dựng hệ thống thông tin, lưu trữ phục vụ công tác quản lý nhà nước về công tác nội vụ trên địa bàn

18. Quản lý vị trí việc làm, biên chế công chức, cơ cấu ngạch công chức trong cơ quan Phòng Nội vụ quận theo quy định của pháp luật.

19. Quản lý và chịu trách nhiệm về tài chính, tài sản của Phòng Nội vụ quận theo quy định của pháp luật và theo phân công của Ủy ban nhân dân quận.

20. Giúp Ủy ban nhân dân quận 8 quy định cụ thể chức năng, nhiệm vụ, quyền hạn của Ủy ban nhân dân phường về công tác nội vụ và các lĩnh vực công tác khác được giao trên cơ sở quy định của pháp luật và theo hướng dẫn của Sở Nội vụ.

21. Thực hiện các nhiệm vụ khác theo sự phân công của Ủy ban nhân dân     quận hoặc theo quy định của pháp luật.

Chương III

TỔ CHỨC BỘ MÁY VÀ BIÊN CHẾ

Điều 3. Tổ chức bộ máy:

Phòng Nội vụ Quận 8 có Trưởng Phòng, không quá 03 Phó Trưởng Phòng và  các công chức thực hiện công chuyên môn, nghiệp vụ.

1. Trưởng phòng chịu trách nhiệm trước Ủy ban nhân dân quận, Chủ tịch Ủy ban nhân dân quận, trước pháp luật về việc thực hiện chức năng, nhiệm vụ, quyền hạn được giao và toàn bộ hoạt động của Phòng Nội vụ quận.

2. Phó Trưởng phòng giúp Trưởng phòng phụ trách và theo dõi một số mặt công tác; chịu trách nhiệm trước Trưởng phòng và trước pháp luật về nhiệm vụ được phân công. Khi Trưởng phòng vắng mặt một Phó Trưởng phòng được Trưởng phòng ủy nhiệm điều hành các hoạt động của Phòng.

3. Việc bổ nhiệm, bổ nhiệm lại, điều động, biệt phái, luân chuyển, chuyển đổi công tác, đánh giá, khen thưởng, kỷ luật, miễn nhiệm, cho từ chức và thực hiện chế độ, chính sách đối với Trưởng phòng, Phó Trưởng phòng do Chủ tịch Ủy ban nhân dân quận quyết định theo quy định.

Điều 4. Biên chế:

1. Biên chế công chức của Phòng do Chủ tịch Ủy ban nhân dân quận quyệt định trong tổng biên chế công chức của quận đã được cấp có thẩm quyền phê duyệt;

2. Việc bố trí công tác đối với công chức của Phòng phải căn cứ vào vị trí việc làm, tiêu chuẩn ngạch công chức và phẩm chất, trình độ, năng lực của công chức.

Chương IV

CHẾ ĐỘ LÀM VIỆC VÀ QUAN HỆ CÔNG TÁC

Điều 5. Chế độ làm việc:

1. Trưởng phòng phụ trách, điều hành các hoạt động của Phòng và phụ trách những công tác trọng tâm. Các Phó Trưởng phòng phụ trách những lĩnh vực công tác được Trưởng phòng phân công, trực tiếp giải quyết các công việc phát sinh.

1. Phó Trưởng phòng khi giải quyết công việc thuộc lĩnh vực mình phụ trách có liên quan đến nội dung chuyên môn của Phó Trưởng phòng khác, Phó Trưởng phòng chủ động bàn bạc thống nhất hướng giải quyết, chỉ trình Trưởng Phòng quyết định các vấn đề chưa nhất trí với các Phó Trưởng phòng khác hoặc những vấn đề mới phát sinh mà chưa có chủ trương, kế hoạch và biện pháp giải quyết.

2. Trong trường hợp Trưởng phòng trực tiếp yêu cầu các cán bộ, chuyên viên giải quyết công việc thuộc phạm vi thẩm quyền của Phó Trưởng phòng, yêu cầu đó được thực hiện nhưng cán bộ phải báo cáo cho Phó Trưởng phòng trực tiếp phụ trách biết.

Điều 6. Chế độ sinh hoạt hội họp:

1. Hàng tuần, lãnh đạo phòng họp giao ban một lần để đánh giá việc thực hiện nhiệm vụ và phổ biến kế hoạch công tác cho tuần sau. Thời gian họp không quá một phần hai ngày làm việc.

2. Sau khi giao ban lãnh đạo Phòng, các bộ phận họp với Phó Trưởng phòng trực tiếp phụ trách để đánh giá công việc, bàn phương hướng triển khai công tác và thống nhất lịch công tác. Thời gian họp từ một buổi đến một ngày làm việc, trường họp đối vời những đề tài, dự án lớn thì thời gian có thể kéo dài hơn

3. Căn cứ vào chương trình công tác hàng năm, hàng thàng của Ủy ban nhân dân quận và yêu cầu giải quyết công việc, Trưởng phòng tổ chức họp toàn thể cán bộ, công chức một lần trong tháng.

Các cuộc họp bất thường trong tháng chỉ được tổ chức để giải quyết những công việc đột xuất, khẩn cấp.

4. Mỗi thành viên trong từng bộ phận có lịch công tác do lãnh đạo Phòng trực tiếp phê duyệt.

5. Lịch làm việc với các tổ chức và cá nhân có liên quan, thể hiện trong lịch công tác hàng tuần, tháng của đơn vị; nội dung làm việc được Phòng chuẩn bị chu đáo để giải quyết có hiệu quả các yêu cầu phát sinh liên quan đến hoạt động chuyên môn của Phòng.

6. Họp tập huấn triển khai có mời Chủ tịch hoặc Phó Chủ tịch Ủy ban nhân dân 16 phường và Thủ trưởng các cơ quan chuyên môn, đơn vị sự nghiệp thuộc quận tham dự thì phải có sự đồng ý của Chủ tịch Ủy ban nhân dân quận. Thời gian họp từ một đến hai ngày.

7. Họp sơ kết, tổng kết hàng năm có mời lãnh đạo của cơ quan chuyên môn cấp trên Chủ tịch hoặc Phó Chủ tịch Ủy ban nhân dân quận. Thời gian họp không quá một ngày làm việc.

8. Các trường họp không tổ chức cuộc họp:

- Họp giải quyết thường xuyên trong tình hình có thiên tai hoặc tình trạng khẩn cấp;

- Họp giải quyết công việc đã được pháp luật quy định giải quyết bằng các hình thức khác không phải thông qua họp;

- Họp kết hợp với giao lưu tham quan, nghỉ mát hoặc dùng hình thức họp để tổ chức vui chơi, giải trí cho cán bộ, công chức.

9. Quy trình tổ chức cuộc họp phải đảm bảo giấy mời họp và tài liệu họp được gửi qua hộp thư điện tử

10. Người chủ trì họp quyết định việc ghi biên bản, ghi âm , ghi hình và lưu trữ theo đúng quy định, Thủ trưởng các cơ quan chuyên môn, đơn vị sự nghiệp thuộc quận, lãnh đạo, cán bộ, công chức Ủy ban nhân dân 16 phường tham dự thì phải có sự đồng ý của Chủ tịch Ủy ban nhân dân quận.

11. Thời gian gửi tài liệu họp chậm ít nhất 03 ngày làm việc trước ngày tổ chức họp định kỳ, đối với cuộc họp đột xuất, thời gian gửi tài liệu thực hiện theo yêu cầu của người triệu tập cuộc họp

Điều 7. Mối quan hệ công tác:

1. Đối với Sở Nội vụ:

Phòng Nội vụ chịu sự chỉ đạo, hướng dẫn, kiểm tra và thanh tra về chuyên môn, nghiệp vụ của Sở Nội vụ, thực hiện việc báo cáo công tác chuyên môn định kỳ và theo yêu cầu của Giám đốc Sở Nội vụ.

2. Đối với Ủy ban nhân dân quận:

Phòng Nội vụ quận chịu sự lãnh đạo, chỉ đạo trực tiếp và toàn diện của Ủy ban nhân dân quận về toàn bộ công tác theo chức năng, nhiệm vụ của Phòng, Trưởng Phòng trực tiếp nhận chỉ đạo và nội dung công tác từ Chủ tịch hoặc Phó Chủ tịch phụ trách khối và phải thường xuyên báo cáo với Chủ tịch, Phó Chủ tịch Ủy ban nhân dân quận về những mặt công tác đã được phân công;

Theo định kỳ phải báo cáo với Chủ tịch, Phó Chủ tịch Ủy ban nhân dân quận về nội dung công tác của Phòng và đề xuất các biện pháp giải quyết công tác chuyên môn trong quản lý nhà nước thuộc lĩnh vực liên quan. 

3. Đối với Ban Tổ chức Quận ủy:

Phòng Nội vụ quận phối hợp với Ban Tổ chức Quận ủy trong việc giải quyết những vấn đề về tổ chức cán bộ thuộc diện Quận ủy quản lý theo yêu cầu của Thường trực Ủy ban nhân dân quận (đề bạt, bổ nhiệm, xây dựng kế hoạch, quy hoạch đào tạo, đào tạo lại cán bộ, công chức, viên chức) đồng thời thường xuyên liên hệ với Ban Tổ chức Quận ủy để nắm được chủ trương của cấp ủy qua từng thời kỳ về công tác tổ chức và cán bộ, qua đó có kế hoạch thực hiện tốt nhiệm vụ.

4. Đối với các cơ quan chuyên môn khác thuộc Ủy ban nhân dân quận:

Thực hiện mối quan hệ hợp tác và phối hợp trên cơ sở bình đẳng, theo chức năng nhiệm vụ, dưới sự điều hành chung của Ủy ban nhân dân quận, nhằm đảm bảo hoàn thành nhiệm vụ chính trị, kế hoạch kinh tế - xã hội của quận. Trong trường hợp Phòng Nội vụ chủ trì phối hợp giải quyết công việc, nếu chưa nhất trí với ý kiến của Thủ trưởng các cơ quan chuyên môn khác, Trưởng Phòng Nội vụ quận tập hợp các ý kiến và trình Chủ tịch Ủy ban nhân dân quận xem xét, quyết định.

5. Đối với Ủy ban Mặt trận Tổ quốc Việt Nam, các đơn vị sự nghiệp, các ban, ngành, đoàn thể, các tổ chức xã hội của quận:

            Khi Ủy ban Mặt trận Tổ quốc Việt Nam quận, phường, các đơn vị sự nghiệp, các ban, ngành, đoàn thể, các tổ chức xã hội của quận có yêu cầu, kiến nghị các vấn đề thuộc chức năng của Phòng, Trưởng phòng có trách nhiệm trình bày, giải quyết hoặc trình Ủy ban nhân dân quận giải quyết các yêu cầu đó theo thẩm quyền.

6. Đối với Ủy ban nhân dân các phường:

a) Phối hợp hỗ trợ và tạo điều kiện để Ủy ban nhân dân các phường thực hiện các nội dung quản lý nhà nước liên quan đến chức năng, nhiệm vụ của Phòng;

b) Hướng dẫn cán bộ phường về chuyên môn, nghiệp vụ của ngành, lĩnh vực công tác do Phòng quản lý.

Chương V

ĐIỀU KHOẢN THI HÀNH

Điều 8. Căn cứ Quy chế này, Trưởng Phòng Nội vụ quận có trách nhiệm cụ thể hóa chức năng, nhiệm vụ của Phòng, quyền hạn, trách nhiệm, chức danh, tiêu chuẩn công chức của Phòng phù hợp với đặc điểm của địa phương, nhưng không trái với nội dung Quy chế này, trình Ủy ban nhân dân quận quyết định để thi hành.

Điều 9. Trưởng Phòng Nội vụ và Thủ trưởng các cơ quan, đơn vị liên quan thuộc Ủy ban nhân dân quận có trách nhiệm thực hiện Quy chế tổ chức và hoạt động của Phòng Nội vụ sau khi được Ủy ban nhân dân quận quyết định ban hành. Trong quá trình thực hiện, nếu phát sinh các vấn đề vượt quá thẩm quyền thì nghiên cứu đề xuất, kiến nghị với Chủ tịch Ủy ban nhân dân quận xem xét, giải quyết hoặc bổ sung và sửa đổi Quy chế cho phù hợp./.

ORGANIZATION AND OPERATION OF DIVISION OF HOME AFAIRS OF DISTRICT 8

CHAPTER I

LOCATION AND FUNCTION

Article 1. Location and function:

1. Location:

The Divison of Home Affairs of District 8 is a specialized agency under the People's Committee of District 8.

The Divison of Home Affairs of District 8 obeys the direction and management of the organization, employment position, civil servant payroll, civil servant rank structure and work of the People's Committee of District 8, and at the same time follows the direction of the People's Committee of District 8 in inspecting  and guiding the expertise and professionalism of the Department of Home Affairs.

2. Function:

The Divison of Home Affairs of District 8 has the function of advising and assisting the District People's Committee in State management of: Organizational apparatus; employment position; civil servant payrolls and civil servant rank structure in State administrative agencies and organizations; employment positions, the structure of public employees by professional titles and the number of people working in public non-business units; salaries for cadres, civil servants, public employees and contract workers in agencies, administrative organizations and public non-business units; administrative reform; local government; administrative boundaries; officials and civil servants; ward cadres and civil servants and part-time people in wards; associations, non-governmental organizations; records, state archives; religion; emulation and reward; youth work.

CHAPTER II

DUTIES AND POWERS

 Article 2. Duties and powers:

The Divison of Home Affairs of District 8 has these following duties and powers:

1. To submit to the People's Committee and the Chairman of the district People's Committee for promulgation decisions and directives; planning, long-term, five-year and annual plans; programs and measures to organize the performance of State administrative reform duties in the field of State management as assigned.

2. To organize the implementation of legal documents, planning and plans after approval; information, propaganda, dissemination, education and monitoring of law enforcement on laws in the fields under their assigned management.

3. For the organization and apparatus:

a) To submit to the People's Committee, the Chairman of the district People's Committee for promulgation a document specifying the functions, duties, powers and organization of the District Division of Home Affairs in accordance with regulations and instructions of the People's Committee of city ​​;

b) To advise and assist the District People's Committee to submit to competent authorities for decision the establishment, merger, division and dissolution of specialized agencies under the District People's Committee;

c) To appraise the content of the draft document specifying the functions, duties, powers and organization of professional agencies and public non-business units under the People's Committee of the district;

d) To appraise schemes on establishment, reorganization and dissolution of public non-business units under the decision competence of the People's Committee of the district according to the provisions of law and as decentralized by the City People's Committee. ;

đ) To advise and assist the People's Committee of the district in submitting to the City People's Committee for decision on the establishment, reorganization and dissolution of public non-business units under the district People's Committee in accordance with the provisions of specialized law;

e) To appraise the establishment, consolidation, merger and dissolution of inter-sectoral coordination organizations under the decision-making authority of the Chairman of the district People's Committee in accordance with law.

4. For the management and use of civil servant payrolls, the number of people working in public non-business units:

a) To appraise and submit to the People's Committee of the district, the Chairman of the People's Committee of the district the staffing plan of civil servants, the plan of annual number of people working of public non-business agencies and units under management of the District People's Committee for the District People's Committee to submit to the City People's Committee according to regulations;

b) To submit to the Chairman of the People's Committee of the district to assign the payroll of civil servants, assign the number of people to work in the public non-business unit after being approved by the competent authority;

c) To assist the District People's Committee in guiding and inspecting the management and use of civil servant payrolls and the number of people working in public non-business units in accordance with law;

d) To summarize and report on the payroll of civil servants, the number of people working in agencies, administrative organizations and public non-business units in accordance with law;

đ) To assist the district People's Committee in generalizing the implementation of regulations on the regime of autonomy and self-responsibility for the use of administrative management funds for State agencies in accordance with law.

5. For the management of job positions, structure of civil servants and public employees:

a) To submit to the District People's Committee for promulgation documents directing and guiding agencies, organizations and units under the district People's Committee to manage the formulation of projects on job positions, structure of civil servants' titles, public employees or projects on adjustment of job positions, structure of titles of civil servants and public employees according to the provisions of law and under the direction and guidance of the City People's Committee;

b) To assist the District People's Committee in urging, monitoring, appraising and synthesizing the development of a scheme on employment positions, structure of civil servants and public employees, or a scheme on adjustment of employment positions and structure of civil servants and public employees in agencies, organizations and units under the management of the district People's Committee to submit to the City People's Committee for appraisal; help the District People's Committee to summarize the list of job positions, structure of titles of civil servants and public employees of the district to submit to the City People's Committee as prescribed;

c) To submit to the People's Committee of the district to implement the use and management of employment positions and structure of titles of civil servants and public employees in agencies, organizations and units of the People's Committee of the district according to regulations, as decentralized or authorized by the City People's Committee.

6. For the construction of government:

a) To advise and assist the People's Committee of the district in organizing and guiding the work of election of representatives to the National Assembly and the election of representatives to the People's Councils at all levels in the locality according to the provisions of law and the guidance of the People's Committees of the city;

b) To assist the People's Committee of the district to submit to the People's Council of the district to elect, remove from duty, remove from office the Chairman, Vice Chairman and other members of the People's Committee of the district in accordance with the provisions of law;

c) To submit to the Chairman of the People's Committee of the district for approval of election results, approval of the dismissal and removal of members of the People's Committee of the ward as prescribed;

d) To assist the district People's Committee in submitting to the Chairman of the provincial People's Committee for approval the election results, approval of the dismissal or dismissal of members of the district People's Committee according to the provisions of law;

đ) To formulate and submit to the People's Committee of the district a project related to the establishment, dissolution, merger, division, adjustment of the boundary of the administrative unit, renaming of the administrative unit, classification of the administrative unit in the locality for the People's Committee to submit to competent authorities for consideration and decision;

e) To advise and assist the District People's Committee to guide and organize the implementation of projects and documents related to administrative boundary work and classification of administrative units after being approved by competent authorities.

g) To assist the People's Committee of the district in managing dossiers, maps of boundaries, landmarks and administrative boundaries of the district in accordance with law;

h) To advise and assist the People's Committee of the district in guiding, inspecting, summarizing and reporting on the implementation of the law on democracy in wards, administrative agencies, public non-business units and enterprises in the locality and the implementation of civil mobilization work of the government according to regulations;

i) To advise and submit to the People's Committee of the district in guiding the establishment, dissolution, merger and inspection, synthesis and report on the activities of street quarter and residential groups in the district according to regulations; carry out work training for heads and deputy heads of street quarter and residential groups according to regulations;

7. For cadres, civil servants and public employees; ward officials, civil servants and people working part-time in wards:

a) To submit to the Chairman of the People's Committee of the district for decision on the recruitment, use, management of employment positions, transfer, appointment, re-appointment, resignation, rotation, secondment, commendation, reward and discipline, assessment, retirement, implementation of salary regimes, remuneration regimes and other regimes and policies for cadres, civil servants and public employees under the management of the District People's Committee according to the provisions of law and decentralization of the City People's Committee;

b) To carry out the management of records, professional training and retraining, management knowledge for officials, civil servants, public employees, ward cadres and civil servants according to the provisions of law according to the management decentralization of the City People's Committee and the guidance of the Department of Home Affairs;

c) To assist the People's Committee of the district in recruiting and managing ward civil servants; implement regimes and policies towards ward officials and civil servants and those who work part-time in wards according to regulations.

8. For administrative reform, civil service and civil servant reform:

a) To submit to the People's Committee of the district to lead, direct, deploy, urge and inspect the specialized agencies at the same level and the People's Committee of the ward to carry out administrative reform and civil service reform. , civil servants in the locality;

b) To submit to the District People's Committee measures to promote administrative reform, speed up the reform of the civil service and civil servant regime in the district;

c) To summarize and report on administrative reform, civil service reform and civil servant reform in the locality according to regulations;

d) To submit to the People's Committee and the Chairman of the People's Committee of the district for decision to assign specialized agencies of the People's Committee of the district to assume the prime responsibility for, or coordinate in the implementation of the contents and work of the administrative reform including: institutional reform, administrative procedure reform, administrative apparatus organizational reform, building and improving the quality of the contingent of cadres, civil servants and public employees, public finance reform, and modernization of the foundation of administrative;

đ) To guide, urge and inspect the implementation of the inter-connected and modern one-stop-shop mechanism at local State administrative agencies;

e) To guide, urge and inspect the specialized agencies under the People's Committee of the district and the People's Committee of the ward to carry out the administrative reform, the reform of the civil service regime and civil servants according to the program, plans and schemes on administrative reform, civil service and civil servant reform approved by competent authorities.

9. To assist the District People's Committee in performing the state management of the organization and operation of associations, social funds and charity funds in the locality in accordance with the law and as authorized by the Chairman of the City People's Committee.

10. For the clerical and archival work:

a) To guide and inspect the implementation of regimes and regulations on records and archives of the State and of the City for agencies and organizations in districts and wards in accordance with law.

b) To make reports and statistics on records and archives according to the provisions of law.

11. For the emulation and commendation work:

a) To advise and propose to the People's Committee of the district to organize emulation movements and implement the reward policy of the Party and State in the district; perform the standing duties of the District Emulation - Commendation Council;

b) To guide, inspect and urge the implementation of plans and contents of emulation and commendation in the district; build, manage and use the emulation and commendation fund in accordance with law.

12. For the religion work:

a) To assist the People's Committee of the district in directing, guiding, inspecting and organizing the implementation of the Party's undertakings, the State's policies and laws on religion and religious work in the district;

b) To assume the prime responsibility for, and coordinate with specialized agencies at the same level in performing the task of state management of religion in the locality as decentralized by the City People's Committee and in accordance with law;

c) To advise and assist the District People's Committee to deal with specific religious issues in accordance with the law and under the guidance of the Department of  Home Affairs.

13. For the youth work:

a) To organize the implementation of legal documents, strategies, programs and plans on youth development and youth work;

b) To guid, propagate, disseminate and educatte the law on youth and youth work as prescribed; settle issues related to youth and youth work according to regulations and decentralization;

c) To assume the prime responsibility for, and coordinate with relevant agencies and other youth organizations in implementing or requesting competent authorities to implement mechanisms and policies towards youth and youth work in accordance with regulations.

14. To submit to the District People's Committee for promulgation guiding documents on domestic affairs works in the locality; provide professional guidance on internal affairs works for agencies and units in the district and the People's Committee of the ward.

15. To inspect, settle complaints, handle according to their competence or report to competent authorities to handle violations of internal affairs in the district according to regulations. Carry out anti-corruption work, practice thrift, and fight waste in accordance with the law and as assigned by the District People's Committee.

16. To perform the work of making statistics, information, and reporting to the Chairman of the District People's Committee and the Director of the Department of Home Affairs on the situation and results of the implementation of internal affairs in the locality.

17. To organize the implementation and application of scientific and technological advances; build an information and archiving system to serve the state management of domestic affairs in the locality

18. To manage employment positions, civil servant payrolls, civil servant rank structure in the district's Division of Home Affairs in accordance with law.

19. To manage and be responsible for the finances and assets of the District Home Affairs Division in accordance with the law and as assigned by the District People's Committee.

20. To help the People's Committee of District 8 specify the functions, duties and powers of the People's Committee of the ward in relation to internal affairs and other assigned work areas on the basis of law provisions and according to the instructions of the Department of Home Affairs.

21. To perform other duties as assigned by the District People's Committee or as prescribed by law.

CHAPTER III

ORGANIZATION OF APPARATUS AND STAFF

Article 3. Organization of apparatus:

The Division of Home Affairs of District 8 has a Chief, no more than 03 Deputy Chiefs and civil servants performing professional work.

1. The Chief of the Division is responsible to the People's Committee of the district, the Chairman of the People's Committee of the district, before the law for the performance of the assigned functions, duties, powers and all activities of the Division of  Home Affairs of the district.

2. The Deputy Chief of the Division helps the Chief of the Division to take charge and monitor a number of work aspects; take responsibility before the Chief of the Division and before the law for the assigned tasks. In the absence of the Chief of the Division, a Deputy Chief of the Division is authorized by the Chief to manage the activities of the Division.

3. Appointment, re-appointment, transfer, secondment, rotation, job change, assessment, commendation, discipline, dismissal, resignation and implementation of regimes and policies towards the Chief of the Division, the Deputy Chief of the Division is decided by the Chairman of the District People's Committee according to regulations.

Article 4. Staff:

1. The civil servant payroll of the Division shall be decided by the Chairman of the district People's Committee in the total civil servant payroll of the district already approved by the competent authority;

2. The work arrangement for civil servants of the Division must be based on the job position, the standard of civil servant rank and the quality, qualifications and capacity of the civil servant.

CHAPTER IV

WORKING MODE AND WORKING RELATIONSHIP

 Article 5. Working mode:

1. The Chief of the Division is in charge and administers the activities of the Division and is in charge of the key tasks. The Deputy Chief sof the Division are in charge of the areas of work assigned by the Chief of the Division and directly handle arising jobs.

1. When dealing with work in the fields under his/her responsibility related to the professional contents of other Deputy Chief of the Division, the Deputy Chief of the Division  actively discuss and agree on the solution, only submitting to the Chief of the Division for decision on problems that have not been agreed with other Deputy Chiefs of the Division or new problems arise without guidelines, plans and solutions.

2. In case the Chief of the Division directly requests the officers and specialists to handle the work within the competence of the Deputy Chief of the Division, such request shall be made but the officer must report to the Deputy Chief of the Division directly subordinate to the Deputy Chief of Division in charge to know.

Article 6. Meeting mode

1. Every week, the leader of the Division holds a briefing once to evaluate the performance of the task and disseminate the work plan for the following week. Meeting time should not exceed one-half of a working day.

2. After handing over the leadership of the Division, the departments will meet with the Deputy Chief of Division directly in charge to evaluate the work, discuss the direction of work implementation and agree on the working schedule. Meeting time is from one session to one working day, in case of large topics and projects, the time may be longer.

3. Based on the annual and monthly work program of the People's Committee of the district and the request to solve the work, the Chief of Division shall hold a meeting of all cadres and civil servants once a month.

Extraordinary meetings in the month are only held to deal with unexpected and urgent work.

4. Each member in each department has a working schedule approved by the division's leader directly.

5. Working schedule with relevant organizations and individuals, shown in the weekly and monthly working schedule of the unit; Working content is carefully prepared by the Division to effectively deal with arising requirements related to the Division's professional activities.

6. The implementation training meeting that invites the Chairman or Vice Chairman of the People's Committee of 16 wards and the heads of specialized agencies and non-business units in the district to attend must have the consent of the Chairman of the People's Committee of the district. Meeting time is one to two days.

7. Annual preliminary and final review meetings with leaders of superior specialized agencies are invited to the Chairman or Vice Chairman of the district People's Committee. Meeting time should not exceed one working day.

8. Cases where meetings are not held:

- Regular meeting to deal with the situation of natural disaster or emergency;

- Meetings to deal with matters prescribed by law to be resolved by other forms other than through meetings;

- Meeting in combination with sightseeing exchange, vacation or using the form of meeting to organize entertainment and entertainment for officials and civil servants.

9. The meeting organization process must ensure that meeting invitations and meeting documents are sent via email

10. The person presiding over the meeting shall decide on the recording, audio recording, video recording and archiving according to regulations, heads of specialized agencies, non-business units in the district, leaders, officials and civil servants of the Committee. People's Committees of 16 wards must have the consent of the Chairman of the district People's Committee.

11. The time for sending meeting documents is at least 03 working days before the regular meeting date, for an extraordinary meeting, the time for sending documents shall comply with the request of the meeting convenor.

Article 7. Working relationship:

1. For the Department of Home Affairs:

The Division of Home Affairs is subject to the direction, guidance, inspection and professional inspection of the Department of Home Affairs, and periodically reports on professional work and at the request of the Director of the Department of Home Affairs.

2. For the People’s Committee of District:

The District Home Affairs Division is under the direct and comprehensive leadership and direction of the District People's Committee for all work according to the functions and duties of the Division, the Chief of the Division directly receives instructions and work contents from the Chairman or Vice Chairman is in charge of the division and must regularly report to the Chairman and Vice Chairman of the District People's Committee on the assigned tasks;

Periodically report to the Chairman and Vice Chairman of the District People's Committee on the contents of the Division's work and propose measures to deal with professional work in state management in related fields.

3. For Organization Board of District Party’s Committee:

The Division of Home Affairs of the district coordinates with the Organization Board of the District Party Committee in solving organizational and personnel issues under the management of the District Party Committee at the request of the Standing Committee of the District People's Committee (promotion, appointment, building training and retraining plans for cadres, civil servants and public employees) and regularly contacting the Organizing Committee of the District Party Committee to understand the policies of the Party Committee from time to time on the organization and staff, thereby making a plan to perform their duties well.

4. For other specialized agencies under the District People's Committee:

To implement cooperation and coordination relationships on the basis of equality, according to functions and tasks, under the general management of the People's Committee of the district, in order to ensure the completion of political tasks and socio-economic plans of district. In case the Division of Home Affairs assumes the prime responsibility for coordinating the settlement of the work, if not agreeing with the opinions of the Heads of other specialized agencies, the Chief of the District Division of Home Affairs shall gather opinions and submit them to the Chairman of the People's Committee of district for consideration and decision.

5. For the Vietnam Fatherland Front Committee, non-business units, departments, branches, mass organizations and social organizations of the district: When the Vietnam Fatherland Front Committees of districts, wards, non-business units, departments, branches, mass organizations, and social organizations of the district have requests and recommendations on matters falling within the functions of the Divisions and the Chief of the Division is responsible for presenting, settling or submitting to the People's Committee of the district to settle such requests according to its competence.

6. For the People’s Committee of wards:

a) To coordinate to support and create conditions for the People's Committees of wards to carry out state management contents related to the functions and duties of the Division;

b) To guide ward cadres on the professions and professions of the branches and fields of work managed by the Division.

CHAPTER V

ENFORCEMENT PROVISIONS

Article 8. Pursuant to this Regulation, the Chief of the Division of Home Affairs of District 8 is responsible for specifying the functions and duties of the division, powers, responsibilities, titles and civil servants standards of the division in accordance with the characteristics of the locality, but not contrary to the content of this Regulation, submit it to the Chairman of the People's Committee of District 8 for decision to implement.

Article 9. The Chief of the Division of Home Affairs of District 8 is responsible for implementing the Regulation on organization and operation of the Division of Home Affairs after decided by the People’s Committee of District 8. In the course of implementation, if problems arise beyond its competence, the division researchs to propose their request to the Chairman of the People's Committee of District 8 to consider, resolve or supply and amend the Regulation for suitable./.
